Constitutional Rights Turrochelle McEachern Introduction to Public Policy/ PAD 525 8/22/2014 Professor Dr. Timothy Smith This report reviews and analyzes individual rights afforded by the constitution and their applicability to the suit for wrongful termination in the case of Korb versus Raytheon. The specific constitutional rights under review are the freedom of speech, freedom of information and challenges associated with employment law. Lawrence Korb, a former Assistant Secretary of Defense and current employee of Raytheon, a large equipment manufacturing company for the U.S. military was terminated after making public statements criticizing defense spending and calling for a reduction of Navy’s fleet. Although Korb is free to express whatever opinions he wishes, his employer, Raytheon does not have to pay him to do so. There is a distinct contrast in the freedom of speech rights of an employee of a private corporation and the freedom of speech rights of an employee of the government. The Massachusetts Supreme Court opinion in the Korb case reminds us of the famous dictum of Oliver Wendell Holmes in an 1892 Massachusetts case that involved a policeman who was a member of a political committee and who solicited money for that committee. The policeman was then discharged from the police department. The ex-policeman petitioned the court for restoration of his employment. The Massachusetts Supreme Court ruled that the petitioner may have a constitutional right to talk politics, but he has no constitutional right to be a policeman (Rbs2.com, 2000). There are few employments for hire in which the employee does not agree to suspend his constitutional rights of free speech as well as of idleness by the implied terms of his contract. I attended Cardinal Spellman High School, a Catholic secondary school in the Bronx, NY. Spellman required girls to wear a uniform skirt and boys to wear beige or blue pants with a tie and a white shirt. A blue school sweater was worn by all and boys were required to be clean shaven everyday for school- uniformity was obviously essential to my education. The teaching ethic at Spellman was one of the teacher exerting supreme authority over their students. Students were not encouraged to express their own opinions or feelings but were taught rather to accept the teacher or textbook's opinions as gospel. Once while interpreting a poem I was told that my interpretation was false because it was contrary to my teacher's. I did not understand why or how there could be only one interpretation of a particular poem. Extreme authority over students also extended outside of the classroom. Teachers were not willing to listen to reasons why a student was late but rather assumed that the cause of their lateness was because of some activity which broke school regulations. After feeling sick one morning I decided to go to the nurse before going to homeroom. As a result I was marked absent eventhough I was obviously present. When I explained the situation to my dean I was told that eventhough I was having an asthma attack that I should have first gone up the flight of stairs to my homeroom, asked permission to go to the nurse, get a pass, and then finally go to the nurse. I could not believe my dean when she told me this and when I asked why I was threatened with another day of JUG if I did not calm down. The debate regarding the education of our children has been going on since the institutionalization of education and will continue as long as we are a liberal democracy full of free thinking citizens. People will always have an opinion and we will, most likely, never be able to please every single person. William Galston and Robert Fullinwider are in full support of teaching a version of history that promotes patriotism and inspires those learning of it to feel a sense of pride and a duty to, in a sense, carry on the mission of the American heroes that have come before us and done great things in terms of the progress for our country. Harry Brighouse is quite different than Galston and Fullinwider in that he believes that by keeping the full truth, gruesome or not, from those that are being educated that we are doing a great disservice to them. I tend to side with Galston and Fullinwider with the feeling that our history needs to be taught in an inspiring sort of way. What benefit do we truly gain by teaching young Americans that yes, in fact, Martin Luther King, Jr. was a great American whose work during the Civil Rights Movement was essential to where we have progressed to as a society today, but he was also an adulterer and plagiarist? By revealing the holes in an American hero’s character we are diminishing his greatness and his impact on the people that have learned of his story years and years after he made such a monumental impact on our country and the progress to end segregation. The gain from sharing that knowledge is extremely minimal compared to the damage it does to the credibility of his work that he is truly known and greatly respected for. It is much simpler and much more productive to producing patriotic citizens if we leave certain, inconsequential parts of the story out. This doesn’t mean we lie to anyone, we simply tell the part of the story that generates the desired feelings of national pride and/or patriotism while instilling the necessary knowledge to generations that will move forward to produce similar greatness, or as Fullinwider puts it, â€Å"historical knowledge contributes to citizenship, and thus â€Å"nation-building,†Ã¢â‚¬  (Fullinwider, 1996, pg. 204). Harry Brighouse is of the belief that by shielding any tiny bit of the truth from children as we educate them we are doing a lot more harm than good to them. Arthur Schlesinger, Jr. sides with Brighouse and establishes that argument that â€Å"writing or teaching history as a means of ‘defining national identity’ turns history ‘into a weapon’,† (Schlesinger, 1999, pg 37). Both Schlesinger and Brighouse would argue that history should never change, all the facts should be laid out on the table and nothing should be held back, because, if we make the decision to hold something out of curriculum, who makes that decision and what qualifies as unnecessary? Schlesinger and Brighouse’s argument centers on the main idea that educators do not have the right to manipulate history. Schlesinger goes in depth in his writings in The Disuniting of America that certain false views of history are wrong, but even dangerous for citizens to be exposed to. He claims that, â€Å"the proper account of our past strengthens the â€Å"common purpose† that holds us together. It reinvigorates the American Creed,† (Schlesinger, 1990, pg. 37). Galston and Fullinwider are on the other side of the argument, they believe that educators should teach history in such a way that instills national pride and creates informed, proud American citizens. Fullinwider calls this type of history â€Å"patriotic history.† He believes that this sort of education will inform, of course, but more importantly will establish a system of values that, in the end, will create citizens. Both Galston and Fullinwider argue for a type of history that they refer to as a â€Å"usable past.† A usable past is one that informs citizens and institutes a willingness to â€Å"make the sacrifices necessary to support and improve the nation’s political institutions,† (Fullinwider, 1996, pg. 207). Truth of the matter, like in the case of the exclusion of facts regarding Martin Luther King, Jr. unfavorable personal lifestyle during the telling of his involvement in the Civil Rights Movement, is that not all men who do great things are great men of high character. In some cases, inclusion of all the facts does nothing to diminish any greatness and may, in fact, create a greater sense of the ability for one single person to make a great impact regardless of any shortcomings they may have. On the other, if all the details are not necessary then why include them? Why would we make a hero less of a hero by revealing the unnecessary truth? Facts that bind the entire story together should never be omitted. Galston and Fullinwider believe in, and support, an education that promotes national pride. They are all for a patriot history, because we will then instill the idea and sense of responsibility in young Americans that they should carry the torch, so to speak, and continue to build upon the greatness that is America. Fullinwider concludes that the purpose of teaching a patriotic history â€Å"is to help students â€Å"develop a keen sense of ethics and citizenship,† so that they might â€Å"care deeply about the quality of life in their co mmunity, their nation, and their world,† (Fullinwider, 1996, pg. 222). In Patriotic History, Fullinwider argues against Schlesinger’s point for the â€Å"nothing left out† type of historical education, by saying the Schlesinger is intending to make history seem very precise and when that becomes the case we’re leaving it up to what truth the educator believes in. Fullinwider goes even further in his argument against Schlesinger’s writing by claiming that Schlesinger’s book The Disuniting of America is, in fact itself, purely history told for effect without the intention to simply inform, but rather to draw out and strengthen commitments to national unity (pg. 210). The presentation of history is storytelling and storytelling must come from a particular point of view. Historical education may never be 100% accurate because we’ll never truly know the intentions or finer details from all the angles or perspectives of each event. Somebody has to tell the story to present the history, but it will always come from a l imited point of view. It is the duty of the educational systems to determine which point of view the story should come from and this is where I agree more with Galston and Fullinwider; before we, as an educational system, decide what we want taught to our citizens, we need to decide what we hope listeners or those being educated should get out of the experience. Like Galston and Fullinwider, I think it is in the best interest for our country to try and promote patriotism and pride in being an American. The responsibility of shaping and molding upstanding, progressive citizens falls on the shoulders of our educational systems as well as public institutions and they both must come together to determine what is best for the development of our nation. Within that responsibility lays the decision of what aspects of history we will teach our young students. For me, it comes down to favoring civic education over philosophic education. I’d rather the goal of our educational programs be to pass along the knowledge necessary to create individuals that feel a loyalty and responsibility to do something great for their country, whether that be along the lines of being a great American hero like Martin Luther King, Jr. or simply by being a consistent, educated, responsible American citizen capable of supporting and functioning within our democracy. I disagree with the argument that by teaching a certain version of history we are limiting a child’s autonomy. We are not enforcing any beliefs or completely eliminating any bit of history, we are simply fostering an environment that will produce good and loyal citizens. Agreeing to tell a story (teaching history) a certain way does not mean we are telling people how to think; quite the opposite. We are inspiring greatness and allowing people to be free thinking and promoting the idea that anyone, common, uncommon and anywhere in between, can make a great impact that will last forever. The argument that exists between the Galston/Fullinwider side of teaching a patriotic history and the Brighouse/Schlesinger side of giving the whole â€Å"truth† regardless of degrading details just muddies the argument that we should really be having: What do we hope to get out of those that are being taught this history? When we look at that question we will be able to work together to find a solution. We could go on forever, just like this argument already has, debating what story to tell and from which perspective, but that, ultimately, gets us nowhere. Well, there are certain activities I would like to take part in before I can no longer do them. I very seldom make idle promises, and I even more seldom tell hollow promises to myself. I am going to have the best possible time I can in accordance to my desires and no one else’s. I have already made up my mind that I want to work towards starting a musical band; therefore, one can be sure I am going to take advantage of the chance and opportunity I have to accomplish it. I also have certain places I want to go or perhaps activities I want to do before my time is up. I have made it up in my mind that I am going to travel to different parts of the world to see places most people will not, or perhaps some places that most people do not even know exist. I am going to make an attempt to do some extreme activities in an attempt to experience life from another angle. Again, an angle most people just do not se e, an angle hopefully a little too far off a tangent the average person. To experience life and take advantage of it, one needs to make promises to oneself. A person may wonder, â€Å"How am I supposed to do this? How can I possibly accomplish anything I want to do?

Schizophrenia is a complex brain disorder that makes it hard for people affected to think clearly, have normal emotional responses, act normally in social situations and tell the difference between what is real and what is not. It makes people withdraw from the outside world and always act out in fear. People suffering from schizophrenia may see or hear things that don’t exist, speak in strange ways, think that people are trying to harm them, and always feel as if they are being watched. They have difficulty in doing activities of daily life. This disease is caused either by one’s genetic make-up or abnormal brain structure. But the environment can be a cause too, as for the environmental factors, more and more research is pointing to stress. Like any other disease, schizophrenia has its own symptoms like strange ways of speaking, inability to express emotion and irrational statements. It is in these symptoms that we can detect persons with schizophrenia. And it is important that we diagnose them for medical treatment for schizophrenia may lead to violent behavior. B. Statement of the Problem People with schizophrenia don’t relate with people well and therefore makes it hard for the people who care for them to maintain a healthy relationship with them, the people they are related to, for example. For Schizophrenic people, it is hard to hold a stable job or even care for themselves. This makes them dependent on others and who else is best to care for them than their own family. However, schizophrenia sometimes results to violent behavior due to their inability to think clearly and belief that people are always trying to harm them. Significance of the Study Schizophrenia is not a rare condition. The lifetime risk of developing schizophrenia is widely accepted to be 1 in a 100. It therefore affects thousands of families. The love and support of a family is vital in treating Schizophrenia but it is difficult to cope with its symptoms. A family member deals with extreme reactions, deterioration from personal hygiene, inability to concentrate and social withdrawal. It is seen that families only put up with the patients for a short period of time because of their frustration in what seems to be lack of progress in treatments. In their inability to understand a person with schizophrenia, a family’s emotional support may wane and some even cut off all contact with their schizophrenic son, daughter, or sibling.

Islam being the fastest growing religion, has adhered a lot of positive as well as negative attention from the media. Due to this vast media influence stereotypes in Islam have increased from terrorism, Muslims have been discriminated merely due to the negative outlook that North America has portrayed upon them. The media tends to entwine the truth and to make Muslims seem perilous. Having that simple coherence of one another will be the start to making a difference. Islam is one of the most inspiring religions in the world. It is practiced in many countries, including Northern Africa, Saudi Arabia, Indonesia, Turkey, Iran, Pakistan and Iraq. Due to it being such a large religion, us people of the west tend to have a little understanding and knowledge about the religion. The very bitter truth is that not many people outside the religion can fully grasp their principles. With so many stereotypes being constantly circulated, it is very hard to get an evident picture about Islam both as a religion and as way of living. The first stereotype has to do with the jihad. Jihad literally means â€Å"The struggle in the path of God†, or â€Å"holy war†. This term unfortunately has been totally misunderstood and made to make it appear as though the Muslim people fight their way through all their problems. Jihad could mean ones spiritual struggle against infidels and does not always refer to actual violence. This pillar of faith has been completely turned around in order to portray Islam in a negative manner, which is surly something that we’ve adapted to through the media. Another stereotype is that women in the Muslim society are not treated equally or with respect. People feel this way because the women often wear a hijab which consists of a veil covering the head. This is actually a personal choice of the women, not a requirement. It was said in the Qu’ran that women and men were to be treated equally. By judging people too quickly we tend to forget to look inside rather then to make assumptions due to an appearance. Stereotypes such as the ones mentioned are absolutely biased and extremely unfair to the Muslim people. Many times, the media does not catch the side of the story where real people are being affected and influenced by what the society thinks and says about them. We seem to act as though we are more superior and that we are perfect and do not make mistakes. Just because some  people from a certain religion make a poor choice does not mean that everyone else is that religion is bound to as well. It is the same with the Muslim people. Just because there are terrorists who hurt themselves and those around them for selfish reasons, does not mean that every other Muslim is just as destructive. I feel that people need to be more open minded and try to do research and become more educated before judging and discriminating. If for once all religions saw eye to eye and did not try to put one another down then we would live in a much peaceful world. By not becoming educated, we basically take someone else’s opinion, or the medias and make it our own without looking deeper into the situation. If we just stop being selfish for just a moment, perhaps we can start again and try to live in harmony with our fellow human beings. During the past two weeks I have learned a lot about Islam, although I did know the basis of the religion people my family practices it. Although some of the thinks that I thought I knew turned out to be totally false I always thought the women never played a role in society and that the Muslim people really did have extremist views. After taking a closer look, I came to realize that I was not even close. It was so interesting and almost relieving to come to that realization that these people are simply misunderstood and are the victims of brutal discriminatory attacks. The biggest thing I learned from all this was not to judge a book by its cover. We can’t really have an opinion or pass judgment on a situation that we know nothing of. I realized now that people twist things in order to get a good story but as soon as people are educated about these matters, the media can no longer fool us into believing it all. Acting upon new knowledge, and most importantly correct knowledge is the way to see through the discrimination and look deep inside. Misconceptions and stereotypes about Islam and the Muslim community have increases majorly in the past couple of years. People have become too quick to judge and believe everything that the media tells them. Through knowledge and coherence about Islam and the Muslim people we would come to understand that it is all a simple misunderstanding and that really the Muslims are victims in this manifesto. We should not let others form opinions in our  head and to stay ignorant to the reality of the world. By doing this we save ourselves from becoming something that is not really human, but more so a robot that’s being controlled by the media, if we just stop and think for ourselves, we could live in harmony, and achieve world peace, a feeling that’s everlasting.
